Questions of Staff
3.2.1 –
In response to Councillor Keith’s inquiry regarding a maintenance hole on Joseph St and the status of railing installation on Cascade St., Director of Public Works Mike Kearns responded that if temperatures moderate, a better patch work can be done for the rest of winter around the Joseph St. maintenance hole. With respect to the railing on Cascade Street, Mr. Kearns reported that although the railing was part of the contract installation, there was a decision made at some point not to re-install. Currently he is attempting to ensure design that will not impede snow removal and still allow for a 1.5 meter regulation width sidewalk.

3.2.2 – In response to Councillor Burden’s concerns on behalf of the Downtown Business Association (DBA) regarding garbage on James Street between Seguin and Mary, and their request for garbage containers mid-block, Mr. Kearns reported that the MOU between Town and DBA identifies that garbage receptacles are removed during winter conditions and a few remain. One of the challenges in wintertime is to place receptacles where they won’t impede snow removal.

2.3 – Councillor Backman commented that she would like the existing garbage receptacles in the downtownarea replaced by bins supporting recycling. In addition, Councillor Backman requested an update on the CIINO initiative to which CAO Clayton Harris responded per the following: The Regional Economic Development Collaborative is composed of all seven West Parry Sound area municipalities; the new EDO James Cox started December 7th with an office located in the Township of The Archipelago building; Chair Michelle Hendry and Mr. Harris met with him yesterday, and will set a meeting with Mr. Cox and the Town’s EDO Vlad Shehovtsov for Thursday.

3.2.4 – In response to Councillor Borneman’s inquiry as to potential for a rink at Kinsmen Park this winter, Mr. Kearns reported that the Health Unit has released guidelines on operating outdoor rinks, and that pending appropriate weather conditions, plans are in place to make an outdoor rink at Kinsmen Park.

3.2.5 – In response to Councillor Keith’s inquiry regarding winter solstice, Mr. Kearns reported that to his knowledge no celebratory plans were in place to recognize winter solstice this year.

5.1 – Tom Parks, OHE Consultants.

Request for exemption from Noise Regulations for Jail Demolition.
Mr. Park gave an explanation of the reason for the requested exemption from the noise regulations by-law and acknowledged that the Ontario Regulations 131/20 which prohibit municipalities from regulating construction noise between 6 AM and 10 PM may mean that his request is not necessary as contractors will be able to work from 6 AM to 9 AM prior to court, from 6 PM to 10 PM after court and on weekends and statutory holidays. In addition, Mr. Park responded to inquiries about how the work will be undertaken, including filling with uncompressible fill; and lighting during nighttime operations.

9.1.1 – Winter Control Level of Service Policy.

That Council endorse and adopt the attached Winter Control Level of Service Policy for roads and sidewalks.

9.2.1 – Extension of Temporary Patio Permissions for Restaurants During COVID-19.
Resolution
Whereas on June 8, 2020 the Alcohol and Gaming Commission of Ontario (AGCO) permitted new patios or temporary additions to patios to provide more opportunities to local businesses while protecting health and safety, subject to municipal requirements, and provided an extension to these timelines on December 9, 2021; and
Whereas the Council for the Town of Parry Sound passed Resolution 2020-067 to permit temporary restaurant and bar patios and opted not to enforce the Zoning By-law or Site Plan Agreements as it related to parking infractions as a result of these patios until January 1, 2021; and
Whereas Covid-19 will be an issue affecting restaurants for the foreseeable future and the Town wishes to extend the timelines of this Resolution to be in tandem with the AGCO’s extension.
Now Therefore be it Resolved that the Council for the Town of Parry Sound supports an extension until January 1, 2022 to the terms noted in Resolution 2020-067.

9.2.2 – Consent Application B/45A&B/2020 – Macazer Holding.

That Council of the Town of Parry Sound hereby supports Parry Sound Area Planning Board Application Number B45A&B/2020 – Macazer Holding.

9.3.1 – The 2019-2020 Annual Report.
Resolution

That Council receive the 2019-2020 Annual Report as attached, and direct staff to make copies of it available to the public and circulated to MP Scott Aitchison, MPP Norm Miller, the Downtown Business Association, the Chamber of Commerce and other agencies and organizations as appropriate.

9.4.1 – Water & Wastewater Rate Study
Sean-Michael Stephen of Watson & Associates Economists addressed Council from a prepared presentation regarding a proposed ten-year sewer and water rate structure to address Council’s previous direction to move to a structure that includes a base charge and consumptive rate that is uniform across all customers. The proposed recommendation includes a differentiated rate based on meter size with no distinction between residential and non-residential customers, and consumptive component based on actual usage for metered customer with no minimum consumption charge. Built into the rate structure are increased annual charges for operating expenditures plus inflation estimated at 2% per year, and capital related expenditure based on the capital funding plan.
Resolution
WHEREAS Council approved a change from the current water and wastewater rate structure to a rate structure with a monthly fixed charge, based on meter size, and a consumptive rate (per gallon/per cubic metre) that is uniform for all customers; and
WHEREAS pricing structure changes were deferred to investigate additional options;
NOW THEREFORE Council hereby approves the posting of the Town of Parry Sound Water and Wastewater Rate Study for public circulation and comment; and
THAT the Water Financial Plan be prepared in the format required under O.Reg. 453/07 and submitted to the Province to maintain the Town’s Municipal Drinking Water Licence; and further
THAT the recommended rates be brought forward for consideration.

Other Business
9.5.1 – West Parry Sound Recreation & Culture Centre.

Spokesperson: Donald Sanderson, Chair, Wellness Centre & Pool Committee
Wellness Centre & Pool Committee Chair Donald Sanderson introduced himself and consultants present, and then proceeded to give a presentation from a series of slides on the proposed West Parry Sound Area Recreation Centre.
In addition, questions posed were responded to by Mr. Sanderson or other members of the team per the following:
– it is unknown whether funding is jeopardized if a municipality pulls out; the project and funding formula would need to be reworked for approval by remaining municipalities.
– although the objective of the proposal was to develop program for the facility using 5 acres, there is an additional 10 acres available as well as 9 acres owned by the Town abutting the property that could be used for additional programming.
– Soil samples have been taken in the parking lot and play field area, and on the existing developed area, and all is buildable.
– the building can be re-oriented or expanding upon once an architect has been selected to proceed with finalizing siting and design.
– The Municipal Joint Service Agreement requires 100% agreement of members to release a municipality from the Agreement, with the rationale that any municipality on its own deciding to undertake a recreation project of this magnitude would be committed for decades.
– 2% of annual operating budget is put into a reserve fund to address future capital expenditures – an industry standard.
– Terms of Reference for the Joint Municipal Service Board are essentially contained within the Agreement – a broad constitutional document to set up the Board.
– with respect to the receipt by other municipalities of the presentation, the Townships of McDougall and The Archipelago have both passed resolutions endorsing the recommendations; the Municipality of Whitestone received the presentation and will decide at a future meeting, which was their planned approach to the issue.
– the operating agent will be determined by the Joint Municipal Service Board; the hope is that an arrangement can be made with the YMCA.
– The YMCA owns the land and is agreeable to leasing it for a nominal amount per year for 100 years. If as a condition of funding the land must be owned by the grant recipient, the YMCA is agreeable to sell the land for a nominal amount.
– consider changing the word “burden” to something more positive in the Joint Municipal Service Board Agreement vis a bis “municipalities shall share the burden of the annual contribution.”
Mayor McGarvey thanked Chair Sanderson and other presenters.
Resolution 2020 – 147
Be it Resolved that subject to all area municipalities agreeing to participate as outlined in the attached report presented by the Wellness Centre & Pool Committee at the December 15, 2020 Meeting of Council, and subject to ICIP funding approval, The Council for the Corporation of the Town of Parry Sound approves the following recommendations:
1. That the YMCA property, as recommended by CS&P Architects be approved as the site;
2. That CS&P Architects Option A be approved for the purposes of designing and constructing the facility;
3. That the cost sharing formula be approved for the allocation of operating and capital costs;
4. That a Joint Municipal Service Board be used by the municipalities, for the purpose of acting as an agent on behalf of the Municipalities, in the constructing, maintaining, fundraising and operating of the West Parry Sound Area Recreation and Culture Centre; 5. That the Joint Municipal Service Board Agreement be approved, and the Mayor and Clerk be authorized to execute the agreement, substantially in the form attached;
6. That pending approval of the ICIP grant application the Steering Committee be directed to take the necessary steps to create the Joint Municipal Service Board;
7. That the Steering Committee be directed to enter into negotiations with the YMCA for the purposes of operating the facility; and
8. That the Steering Committee be directed to enter into negotiations with the YMCA to secure the approved site.

9.5.2 – Request for Exemption from Noise Regulations By-law.
Resolution
Whereas Council has received a request per attached Schedule A for exemption from the Noise Regulations By-law 2009-5301; and
Whereas no concerns have been raised by Town staff with respect to the request for exemption, and
Whereas Ontario Regulation 131/20 filed April 7, 2020 and in effect for 18 months from date of filing, denies a municipality the power to prohibit and regulate noise with respect to construction activity in a municipality between the hours of 6 AM and 10 PM
Now Therefore the Council of the Corporation of the Town of Parry Sound does hereby grant the applicant all requested exemptions from the Noise Regulations By-law 2009- 5301 per application attached as Schedule A.

That Council accept the quote from Safe N Sound Locksmithing for the installation of security access controls (Fob system) for the Municipal Office in the amount of $18,290.00.

Resolution

That Council accept the tender from Adams Brothers for snow removal on town streets during the 2020 fall & winter season and 2021 winter & spring season, including traffic control and labour costs to clear around infrastructure including tree pits and hydrants, as follows:
– Tandem dump truck: $95.99 per hour o Wheeled loader: $111.81 per hour.
– Blower and control unit: $111.81 per hour.
This tender being the only one received.

9.2.1 – EMS Committee Member Appointment.
Resolution

That the Town of Parry Sound Council appoint Councillor Irene Smit representing the municipalities of Nipissing, Powassan and Callander to the Parry Sound EMS Advisory Committee for the remainder of the term of Council.

9.2.2 – BSM Breakwater and Dock C Replacement.
Resolution

That the Town of Parry Sound accept the bid by Kropf Industrial in the amount of $1,598,718 plus HST for the construction and delivery of a Floating Breakwater and replacement of Dock C per their tender submission; and
That a previously approved budget amount of $1,293,240 from the Big Sound Marina Reserve be used to fund this project; and
That an additional budget of $400,000 towards Dock C, contingency, HST, engineering and other provisional items be approved to be funded temporarily form the Capital Asset Legacy Reserve Fund; and
That the funds temporarily borrowed from the Capital Asset Legacy Reserve Fund be repaid over a 4-year term with interest, equivalent to the Town’s current interest on reserve fund bank accounts over the term, applied to the outstanding amount borrowed; and
That the repayment of the temporary borrowing begin in the 2021 budget year; and
That the total revised budget for this project be $1,693,240 including the Breakwater, provisional items, Dock C, contingency, and engineering costs.

9.3.1 – Extension of Virtual Council Meetings.
Resolution
Whereas the COVID-19 Economic Recovery Act, 2020, S.O. 2020, c. 18 expanded the opportunity for Municipal Councils, Local Boards and their Committees to meet electronically, and
Whereas in response, Council passed By-law 2020 – 7061 permitting by means of a resolution, certain expanded terms of electronic participation at meetings of Council, Local Boards and its Committees; and
Whereas pursuant to By-law 2020-7061, Council extended by Resolution 2020-082 until October 31st expanded terms of electronic participation at meetings; and
Whereas recent provincial reports identify a current “second wave” of COVID-19 infections “worse than the first”, prompting a return to more stringent public health precautionary measures,
Now Therefore Be It Resolved that Council of the Corporation of the Town of Parry Sound extends until March 31, 2021 the terms of electronic participation at meetings of Council, Local Boards or Committees of either them per the following:
a) electronic participation counts towards quorum;
b) electronic participants are permitted to vote; and
c) electronic participation is permitted in a meeting closed to the public.

9.3.2 – COVID-19 Municipal Office Response Plan.

That Council approves continued implementation of the internal safety protocol set out in the plans attached as Schedules A and B, and continued restriction on public access to the municipal office and Fire Hall until the end of the year 2020, at which time it will be reassessed.

9.3.4 – EDO for the West Parry Sound Economic Development Collaborative (CINNO Funding Program), 3 Year Employment Contract.

That on behalf of the Regional Economic Development Collaborative, Council authorizes staff to enter into a 3-year fixed contract for a Regional Economic Development Officer provided that each member municipality agrees to cover their proportionate share of all employment related costs in the form, substantially as set out in this report.

9.5.1 – AODA Website Compliance Extension Request.
Resolution
Whereas the Town of Amherstburg passed Resolution 20200914-214 per attached Schedule A;
Now therefore be it resolved that the Town of Parry Sound hereby requests that the Province of Ontario extend the compliance deadline stated in Section 14(4) of O.Reg 191/11 under the Accessibility for Ontarians with Disabilities Act to require designated public sector organizations to conform to WCAG 2.0 Level AA, by a minimum of one (1) year to at least January 1, 2022; and further,
That the Town of Parry Sound requests that the Province of Ontario consider providing funding support and training resources to meet these compliance standards.

There is lots on the agenda this week. I have highlighted below a few of the more interesting items with a little bit of commentary. Refer to the full list of agenda items that follows and the full agenda, with attachments that are available at the Town’s website.

Closed c) & d) a proposed or pending acquisition or disposition of land by the municipality or local board, (Boundary negotiations).
This is something we haven’t heard anything about for the past year or more. There were discussions perhaps five years ago about the transfer of land to the Town of Parry Sound at the request of certain property owners who wanted to access the Town’s infrastructure. This was turned down by a majority of the landowners in the area, largely of the basis of projected higher taxes. Then about 18 months ago additional overtures were either made or received by the Town. I am not sure if these items are related or it is something altogether different. It’s obvious that the Greater Parry Sound area is attracting new residents and housing is in short supply. They will expect services, even if taxes are higher than the ‘burbs’.

4.4 – Honourable Lisa Smith, Ministry of Government & Consumer Services.
Delegation at AMO Conference re: MNRF 7 Bay Street property disposition and subsequent retention of MNRF jobs in area.
There is little to be read in the letter from the Minister. It seems to be a brush off, but that’s almost always how these discussions start. The Town would like to acquire the property but not lose the associated jobs. A get your cake and eat it too situation?

9.2.2 – BSM Breakwater and Dock C Replacement.
Remember the move the Money Pit about a young couple that buys a house and faces challenges and mostly expenses with the renovations? Well the town has three of them – the Bobby Orr Community Centre, the Stockey Centre and now Big Sound Marina. The property was received at no cost from the Federal Government along with $1.3 million for necessary repairs and upgrades. The Town is now tossing in another half million or so for additional upgrades. It seems that these three money pits are here to serve tourists and the neighbouring communities. Are we, the taxpayers who subsidize these facilities, getting our money’s worth? And there is the possibility of a fourth money pit, a ‘recreation and culture centre’ (aka a pool). Can we really afford all of this without more land to provide additional taxable property income?

9.3.3 – Key Performance Objectives in Support of the Strategic Plan
Resolutions.
I am putting this on my to-do list to review. A quick glance reveals a limited number of objectives with few details. Less is okay if they actually get done and aren’t dragged over from year to year.

10.2.1 – Amend Parking and Traffic Control By-law 2019-6912 to prohibit parking on Waubeek Street.
This is good news. Last week saw a letter and deputation to Council requesting Waubeek on street parking. I drove down Waubeek at night last week and was surprised how relatively narrow the street was. What happens in the winter? Well, Council is being presented with a by law amendment that prohibits parking on Waubeek Street. That seems to be the right things to do.
As an aside – is anyone else surprised with how ‘bumpy’ Waubeek Street is after the rebuild and repaving? There are two issues in my opinion. Didn’t we pay lots to get this work done? Is this type of quality we paid for? The second concerns the durability of the street. A ‘bumpy’ rebuild and paving is more than a bit of a rougher ride, it suggests that the road won’t last as long. Erosion and wear start more easily from bumps and depressions. Ever notice how a pothole grows quickly once it has first formed. The small imperfections in the Waubeek Street job will lead to issues sooner than they should have. Compare this with the repaving done on Highway 400 and the exit ramps to the Town. Smooooth! Very smooth! They don’t want to be doing this any sooner than they need to.

9.2.2 – BSM Breakwater and Dock C Replacement.

That the Town of Parry Sound accept the bid by Kropf Industrial in the amount of $1,598,718 plus HST for the construction and delivery of a Floating Breakwater and replacement of Dock C per their tender submission; and
That a previously approved budget amount of $1,293,240 from the Big Sound Marina Reserve be used to fund this project; and
That an additional budget of $400,000 towards Dock C, contingency, HST, engineering and other provisional items be approved to be funded temporarily form the Capital Asset Legacy Reserve Fund; and
That the funds temporarily borrowed from the Capital Asset Legacy Reserve Fund be repaid over a 4-year term with interest, equivalent to the Town’s current interest on reserve fund bank accounts over the term, applied to the outstanding amount borrowed; and

9.3.1 – Extension of Virtual Council Meetings
Resolution
Whereas the COVID-19 Economic Recovery Act, 2020, S.O. 2020, c. 18 expanded the opportunity for Municipal Councils, Local Boards and their Committees to meet electronically, and
Whereas in response, Council passed By-law 2020 – 7061 permitting by means of a resolution, certain expanded terms of electronic participation at meetings of Council, Local Boards and its Committees; and
Whereas pursuant to By-law 2020-7061, Council extended by Resolution 2020-082 until October 31st expanded terms of electronic participation at meetings; and
Whereas recent provincial reports identify a current “second wave” of COVID-19 infections “worse than the first”, prompting a return to more stringent public health precautionary measures,
Now Therefore Be It Resolved that Council of the Corporation of the Town of Parry Sound extends until March 31, 2021 the terms of electronic participation at meetings of Council, Local Boards or Committees of either them per the following:
a) electronic participation counts towards quorum;
b) electronic participants are permitted to vote; and
c) electronic participation is permitted in a meeting closed to the public.

9.3.2 – COVID-19 Municipal Office Response Plan.

Reg 191/11 under the Accessibility for Ontarians with Disabilities Act to require designated public sector organizations to conform to WCAG 2.0 Level AA, by a minimum of one (1) year to at least January 1, 2022; and further,

Disclosure of Pecuniary Interest and the General Nature Thereof
1.4.1 – Councillor Horne declared pecuniary interest on EMS items 9.1.1, 9.1.2, and 9.1.3. referring respectively to the EMS budget deficit repayment to the West Parry Sound Health Centre, the 2020 EMS supplementary levy to area municipalities, and the appointment of a member to the EMS Advisory Committee, as his spouse is Chief Operating Officer of the West Parry Sound Health Centre and has direct involvement with the EMS Committee. Deputy Mayor McCann and Councillors reported on meetings attended and matters arising. In Deputy Mayor McCann’s report, he noted that Belvedere Heights Board participating municipalities declined to approve of a resolution to request the province to increase funding to Long-Term Care facilities particularly for funding full-time workers. Such a resolution was on the July 7th, 2020 Council agenda and was postponed for input from Belvedere Heights Board. Deputy Mayor McCann therefore reported that as initiator of this resolution, he would not be bringing it back for Council consideration.

Mr. McIntyre’s letter (4.1) is worth reading and can be found in the full agenda package available at the Town’s website. He points out some of the safety issues faced by pedestrians in the Avenue Road area. While I don’t walk there I am conscious of the issues when cycling in the area. Although the issues may be reduced with Waubeek Street open, the area remains dangerous because of the narrow winding streets with limited sight lines.

A quick review of the summarized agenda as presented below will give you a good sense of whether you should look at the full agenda.

9.2.1 – 2020 Land Ambulance Budget. Resolution. That upon the recommendation of the EMS Advisory Committee the Council of the Town of Parry Sound approves the 2020 Land Ambulance Budget in the amount of $9,995,709.00

9.2.2 – EMS Ambulance and Paramedic Response Unit Replacements for 2020. Resolution. That upon the recommendation of the EMS Advisory Committee the Council of the Town of Parry Sound approves the replacement of two ambulances to be delivered in late winter 2020 and further that the supplier of record, Crestline, be awarded the contract for the supply of these two ambulances in the amount of $129,427.21 +HST each; said ambulances funded from the EMS equipment reserve fund; and
That the upon delivery of the 2020 ambulances the two being replaced be deemed surplus and donated to First Response Teams within the District of Parry Sound.
Resolution. That upon the recommendation of the EMS Advisory Committee the Council of the Town of Parry Sound approves the replacement of one Paramedic Response Unit (PRU) to be supplied by Rowland Emergency Vehicle in the amount of $70,475.00 + HST; said PRU funded from the EMS equipment reserve fund.

9.2.3 – Reappointment of Councillors to Committee of Adjustment Spokesperson: Taylor Elgie, Manager of Building and Planning Services. Resolution. That Councillors Horne and Keith be reappointed to the Parry Sound Committee of Adjustment until December 31, 2020.

9.2.4 – Re-Parking, Downtown Parry Sound. Direction. That Council for the Town of Parry Sound receives the Re-parking report and directs staff to bring the proposed changes forward in January 2020.

9.3.1 – Information Update: Town of Parry Sound Culture, Parks & Recreation Master Plan. Resolution. That the staff update on the Town of Parry Sound Culture, Parks and Recreation Plan be received for informational purposes.

9.3.2 – Modernization Program – Intake 1, Digital Strategy. Resolution. WHEREAS the Province announced the provision of the Municipal Modernization Program which is a funding program to identify efficiencies, NOW THEREFORE BE IT RESOLVED that staff be authorized to indicate to the Province the Town’s Expression of Interest and subsequently submit an application for municipal modernization funding resulting in a third-party assessment of opportunities to utilize information technology to achieve efficiencies, taking into consideration needs, resource requirements, best practices and also the identification of cost saving/sharing with other municipalities through shared technology opportunities.

9.4.1 – Financial Variance Report for Third Quarter 2019. Resolution. That Council hereby receives and accepts the variance report for the Third Quarter 2019 (September 30, 2019); and
Further that Council hereby approves the expenses for Council members for the period from July 1, 2019 to September 30, 2019.

By-laws

10.1.1 – Stewardship Ontario MHSW Amending Agreement. By-Law 2019 – 6996. Being a by-law to execute the Stewardship Ontario MHSW amending service agreement and amend Bylaw 2008-5281.

10.1.2 – Encroachment Agreement – 4 River Street. By-Law 2019 – 6997. Being a by-law to execute an encroachment agreement between the owner of 4 River Street and the Town of Parry Sound.

10.1.3 – Electronic Waste Agreement. By-Law 2019 – 6998. Being a by-law to amend Bylaw 2011-6029 to continue the electronic waste agreement and to reflect the change in ownership from Global Electric Electronic Processing (GEEP) to Quantum Lifecycle Partners and to execute the Notice of Assignment to confirm the Town of Parry Sound’s agreement with the change in ownership.

10.2.1 – Rezoning Application – Z/19/14 – College Drive (M2 Developments Inc.). By-Law 2019 – 6999. Being a By-law to amend By-law No. 2004-4653 (The Zoning By-law), as amended, for Z/19-14 – 12 College Drive (M2 Developments Inc./Gardens of Parry Sound).

I thought this was going to be a “nothing burger” agenda package until I took a look at the attachments. Item 9.3.2 provides an overview, with architectural drawings of what is now referred to as the “West Parry Sound Area Recreation and Culture Centre”, 49,000 square feet and $32 million. The funding request submitted to upper tier government is for $23.5 million leaving the seven municipalities and two First Nation communities on the hook for $8.5 million. While I would normally suggest you go to the Town’s website to download the full agenda package I have clipped the proposal portion of the agenda package and made it available through this link.

Beyond that the agenda is a nothing burger. No, wait, there is Item 10.2.2, Lighthouse Official Plan Amendment (OPA) and Zoning By-law Amendment (ZBA). This includes the report from outside consultants regarding the proposed condominium development on Salt Dock Road. Once again, I have clipped the appropriate section from the agenda and made it available through this link. (It’s 226 pages in length.)

I will not present my opinions on either of the two items, but I will note that if the West Parry Sound Area Recreation and Culture Centre is in fact funded and developed it will fundamentally transform the Town of Parry Sound and the surrounding communities. On both items I plan to keep my opinions to myself. There are enough opinions out there already. I will focus on the numbers and the implications that are not so obvious.

4.1 – District of Parry Sound Violence Against Women Coordinating Committee. Request that the Municipal office flags be lowered to 1/2 mast on December 6, 2019 to mark the National Day of Remembrance and Action on Violence Against Women and specifically to remember the lives lost on December 6th, 1989 of 14 young university students at l’École Polytechnique de Montréal.

4.2 – Climate Action Parry Sound. They are a grassroots organization of concerned citizens committed to limiting and mitigating the effects of human-caused global warming introducing their group to Council.

By-laws

10.1.1 – Curbside Waste & Recycling Collection Contract Extension. By-law 2019 – 6994. Being a bylaw to amend bylaw 2011-6048 and bylaw 2019-6890, to authorize the execution of an extension of the existing curbside waste and recycling collection contract with Waste Connections of Canada Inc. for one year, ending December 31, 2020.

10.2.1 – Municipal Office and Firehall Custodial 2020 and 202. By-law 2019 – 6984. That Council authorizes the execution of a contract with Bernie Filiatrault’s Janitorial for Custodial services of the Municipal Office and Council Chambers set-up.
By-law 2019 – 6985. That Council authorizes the execution of a contract with Bernie Filiatrault’s Janitorial for Custodial services at the Firehall Complex.

10.2.2 – Lighthouse Official Plan Amendment (OPA) and Zoning By-law Amendment (ZBA). Spokesperson: Jamie Robinson, MHBC Planning, Urban Design & Landscape Architecture.
By-law 2019 – 6991. Being a By-law to Adopt Official Plan Amendment No. 2 – Part of Block Q of Plan 123 and a portion of Part 7 of 42R129.

10.3.1 – Parry Sound Area Founders Circle Agreement. By-law 2019 – 6993. Being a by-law to authorize the execution of an Agreement with the Parry Sound Area Founders Circle to support business innovation and new business’s ideas.

10.4.1 – Debenture issue for completed 2018 and 2019 Capital Works.
By-law 2019 – 6989. A By-law of the Corporation of the Town of Parry Sound to Authorize the Borrowing Upon Amortizing Debentures in the Principal Amount of $727,779.50 Towards the Cost of the Stockey Centre Roof/Hardy Board Siding.
By-law 2019 – 6990. A By-law of the Corporation of the Town of Parry Sound to Authorize the Borrowing Upon Amortizing Debentures in the Principal Amount of $860,435.56 Towards the Cost of the Bobby Orr Community Centre Ice Pad Replacement

There are some interesting developments as noted below.

Closed Session f) and 4.2, – Canadore and French School. Things are clear with respect to what comes next. The French School will be in Canadore for at least the next year after an Ontario Superior Court injunction. I don’t have a dog in this fight as my kids finished primary school a couple of decades ago. That being said we probably would have sent our kids to a French school had it been an option. I think Town of Parry Sound Council shot themselves in the foot with their decision. Had I been at the table with the same interests of Council I would have agreed to the one-year occupancy in exchange for a ‘standstill’ agreement with the French Board that would have prevented the French Board and Canadore from entering into any future agreement to sell/transfer the Canadore campus to the French Board at some future date. I suspect that Canadore is interested in retreating from Parry Sound given the financial realities of providing adult education. Unless the Town of Parry Sound, and possibly the surrounding municipalities, is willing to subsidize adult education it is likely that there will not be any local post-graduation education opportunities in the area. Is Bracebridge really that far away for people who want an education? It would make it tougher but not impossible. The letter, Item 4.2, is worth reading for context from one side of the discussion.

5.3 – Jo Bossart. Request for Closed Report & Recommendation item. I’m asking for the background information related to the recent acquisition of Big Sound Marina and future plans. I’m getting questions from members of the community about what’s going on at the Waterfront for which Council has not provided public information. (Democracy Dies in Darkness – Washington Post)

9.1.1 – Big Sound Marina Agreement One Year Extension with Massasauga Management Co. Resolution. The interesting thing in this item is the passing mention that while Big Sound Marina will be acquired by the Town, the Town Dock isn’t part of the deal. There is mention of a lease of the Town Dock.

9.2.1 & 9.2.2 – Wellness Centre & Pool. Based on the documentation in the agenda package I am beginning to believe that the area will have a pool complex, and I’m not against it. The documentation seems to suggest that the area communities are considering a joint funding agreement presumably for construction costs and operations that allocates funding support on the basis of a number of parameters, notably population, assessments and distance from the Town of Parry Sound. The Town’s share would be the highest at about 25% with Whitestone at the low end at a 6.1% commitment. These are the figures for the sharing of the due diligence expenses but might point to where the final cost sharing could be agreed. (Many hands make light work.)

Resolutions and Direction to Staff

9.1.1 – Big Sound Marina Agreement One Year Extension with Massasauga Management Co. Resolution. That staff negotiate a one-year extension with Massasauga Management Co. for the operation of Big Sound Marina similar to the current terms and conditions and prepare an RFP process to be run throughout the winter for the operation of BSM and Town Dock from October 2020 to October 2024.

9.1.2 – Land Ambulance Contract. Resolution. That upon the recommendation of the EMS Advisory Committee, the Town of Parry Sound Council authorize the extension of the Land Ambulance Contract (same terms and conditions) with the West Parry Sound Health Centre for an additional year ending December 31, 2020.

9.2.1 – Wellness Centre & Pool. Resolution. That subject to all area municipalities agreeing to participate as outlined in this report to Council entitled Wellness Centre and Pool dated September 3, 2019, the following recommendation be approved:
That the Decision-Making Model, Schedule A (Attachment 1 to report) be approved;
That the Wellness Centre and Pool Committee Terms of Reference, Schedule B (Attachment 3 to report) be approved;
That the Mayor/Reeve or other member of Council be appointed to the Wellness Centre and Pool Committee;
That Council appoint _____________ as an alternate member of Council in the event the designate cannot attend a meeting;
That the Wellness Centre and Pool Committee be allocated a budget of $170,000, excluding HST to fund the due diligence and governance work; and
That the cost sharing formulae, as outlined in the report, Schedule C (Attachment 4 to report) be approved for the purposes of funding the due diligence work covered by the RFP and preparing a governance framework.

9.2.2 – Investing in Canada Infrastructure Program – Community Culture and Recreation. Direction. That a request be forwarded to the six (6) area municipalities and the First Nations of Wasauksing and Shawanaga to submit a joint funding application under the Investing in Canada Infrastructure Program: Community Culture and Recreation for the Wellness Centre and Pool project.

9.3.1 – Water and Wastewater Rate Study and O.Reg 453.07 Water Financial Plan. Resolution. That Council hereby approves the undertaking of a Water and Wastewater Rate Study followed by a Water Financial Plan by Watson & Associates Economists Ltd. (Watson) for the estimated cost of $34,920 before HST. The Water and Wastewater Rate Study with the Financial Plan is to be funded 50% from the Water Stabilization Reserve and 50% from the Wastewater Stabilization Reserve.

9.3.2 – Financial Variance Report for Mid-Year 2019. Resolution. That Council hereby receives and accepts the variance report for Mid-Year 2019 (June 30, 2019); and Further that Council hereby approves the expenses for Council members for the period from January 1, 2019 to June 30, 2019.

9.4.1 – Conservation and Demand Management Plan. Resolution. That Council approves the 5-year Conservation and Demand Management Plan, attached as Schedule “A”, for the Town of Parry Sound’s facilities and infrastructure as per Ontario Regulation 507/18.

9.4.2 – Bowes Street Storm Sewer Replacement Tender Award. Resolution. That upon the recommendation of Tatham Engineering Limited, Council accept the tender from Fowler Construction Company Limited for the storm sewer replacement on Bowes Street, in the amount of $106,473.80, excluding HST, this tender being the lowest of two tenders received.

9.4.3 – Commitment and Endorsement of Drinking Water Quality Management Standard. Resolution. That Council authorize the Mayor and CAO to endorse and approve the Town of Parry Sound Drinking Water Quality Management Standard and Operational Plan by signing the Commitment and Endorsement of QMS and Operational Plan, attached as Schedule “A”.

9.5.1 – Opposition to Changes in 2019 Provincial Budget and Planning Act – (as postponed from August 13, 2019 meeting). Resolution. BE IT RESOLVED that Council for the Corporation of the Town of Parry Sound, accepting the facts and sentiments expressed in the City of Stratford’s resolution attached as Schedule A regarding opposition to Changes in the 2019 Provincial Budget and Planning, does hereby request a meeting with MPP Norm Miller, Minister of Municipal Affairs and Housing Steve Clark, and other related ministries on the effects of downloading onto municipal governments;
and THAT this resolution be forwarded to the Association of Municipalities of Ontario (AMO), to initiating municipality the City of Stratford, and to all other municipalities in Ontario.

By-laws

10.4.1 – Cellular phone contract renewal / refresh with Bell Mobility Inc. By-law 2019 – 6946. Being a by-law to authorize the execution of a contract with Bell Mobility Inc., for the purpose of updating / renewing / refreshing the cellular phone, voice and data contract for the Corporation of the Town of Parry Sound and repeal Bylaw 2016-6627.

10.4.2 – Cemetery By-law. Direction. That staff be directed to forward this by-law to the Bereavement Authority of Ontario for approval.
By-law 2019 – 6952. Being a By-law to establish the maintenance, management, regulation and control of the Hillcrest Cemetery and Sylvan Acres Cemetery and to repeal By-law 2019-6940.
